1) About the App
 

Port Guide & Distances provides two offline modules:

• Port Guide — unofficial, descriptive port information compiled from publicly available sources and the professional field notes of a mariners.
• Port Distances — port-to-port distance checks with a schematic route line and ETA estimate.
  Core features are available offline. Routing data is generated from a combination of public, licensed, and proprietary materials, together with professional maritime practice. The database is an original compilation created by Marine Solutions SD Group.
   

2) Acceptance of Terms
 

By installing or using the App, you agree to these Terms and the applicable store rules (Apple/Google). If you do not agree, do not use the App.

3) License
 

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own/control, solely for lawful purposes and in accordance with these Terms. We retain all rights not expressly granted.

4) Non-Affiliation & Sources
 

We are not affiliated with nor endorsed by any confidential/proprietary database or third-party software. Content is compiled from public sources and professional experience. The App does not reproduce third-party proprietary databases. All routing information is compiled independently from the sources described above.
 

5) Critical Disclaimer — Not for Navigation
 

The App is for informational and educational purposes only. It provides unofficial, descriptive information and schematic routes. It is not a substitute for official nautical publications, charts, NtM, VTS/Harbour Master instructions, company procedures, or onboard ECDIS/official systems.
Do not use the App for navigation, operational decision-making, or safety-critical activities. Always verify with current official sources. All distances and schematic routes are approximate and must be verified against current official charts and publications.

 

6) Subscriptions, Billing & Refunds
 

• Core features may be free; premium features require an in-app purchase/subscription processed by Apple/Google.
• Billing cycles, auto-renewal, price changes, free trials, and refunds are governed by the respective store’s terms.
• Manage/cancel subscriptions in your store account settings. We do not handle or store payment card data.

7) Acceptable Use
 

You agree not to:
a) use the App for navigation or safety-critical decisions;
b) copy, modify, reverse engineer, decompile, or create derivative works except where permitted by law;
c) remove proprietary notices or infringe third-party IP;
d) use the App unlawfully, to harass, or to harm others;
e) attempt to circumvent technical protection measures.

8) Content Accuracy & Availability
 

We strive for useful, descriptive content but do not guarantee accuracy, completeness, or availability. Information can be outdated or incomplete. Features may change or be discontinued at any time.

9) Third-Party Terms (Apple/Google)
 

Your use of the App is also subject to Apple Media Services/Google Play terms. Where any Apple/Google terms conflict with these Terms, their mandatory platform terms apply.

10) Intellectual Property
 

All rights, title, and interest in the App (software, UI, text, graphics, databases created by us) belong to Marine Solutions SD Group or its licensors. Third-party names/trademarks belong to their respective owners. The routing database and algorithms are proprietary to Marine Solutions SD Group. They are the result of independent compilation and processing.
 

11) No Warranties
 

The App is provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, accuracy, and non-infringement. You assume all risk for your use.

12) Limitation of Liability
 

To the maximum extent permitted by law, Marine Solutions SD Group and its affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages; loss of profits, data, business, goodwill; or personal injury/property/environmental damage, arising from or relating to your use of the App or reliance on its content.
Where liability cannot be excluded, it is limited to the amount you paid for the current subscription period (if any).

13) Indemnity
 

You agree to indemnify and hold Marine Solutions SD Group harmless from claims, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the App.

14) Suspension/Termination
 

We may suspend or terminate access to some or all features at any time (e.g., maintenance, legal compliance, security concerns). Your license ends immediately if you breach these Terms.

15) Export Controls & Sanctions
 

You must comply with applicable export control and sanctions laws. You may not use or export the App where prohibited.
 

16) Governing Law & Venue
 

These Terms are governed by the laws of Ukraine (conflict-of-law rules excluded). Exclusive venue: Kyiv, Ukraine, unless mandatory consumer law provides otherwise.

 17) Changes to Terms

We may update these Terms at any time. Continued use after the Last updated date constitutes acceptance of the revised Terms.
